1. General
1.1 These general terms and conditions apply to all orders placed via our online shop.

1.3 A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity.
1.4 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
1.5 Differing or conflicting terms and conditions of the customer only apply if we have expressly agreed to their validity.
2. Conclusion of contract
2.1 The presentation of the products in our online shop does not represent a legally binding offer to conclude a purchase contract, but rather a non-binding invitation to place an order.
2.2 The customer can place the desired products in the shopping cart and check and correct their entries before submitting the order.
2.3 By submitting the order using the button provided, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
2.4 After receipt of the order, the customer automatically receives a confirmation by email. This confirmation of receipt merely documents that we have received the order and does not constitute acceptance of the offer.
2.5 The purchase contract is concluded as soon as we expressly confirm the order, send a shipping confirmation or ship the ordered goods to the customer.
2.6 If payment has already been made for an order and the offer is not accepted, the corresponding amount will be refunded immediately.
2.7 The contract language is German.
3. Prices and payment options
3.1 The prices stated in the online shop at the time of ordering apply.
3.2 The prices stated include statutory sales tax, if applicable. Additionally, shipping costs may arise in accordance with Section 5 of these General Terms and Conditions.
3.3 The available payment options are displayed to the customer in the checkout during the ordering process.
3.4 The due date for payment depends on the payment method chosen by the customer. If payment service providers are used, their respective contract and payment conditions may also apply.
3.5 For deliveries to countries outside the European Union, especially to Switzerland or Great Britain, additional customs duties, import sales taxes or other charges may arise. Unless they are expressly included in the checkout, such taxes are levied by the responsible authorities and must be borne by the customer.
4. Delivery and delivery times
4.1 We deliver within Germany as well as to Austria, Italy, France, the Netherlands, Belgium, Luxembourg, Denmark, Spain, Switzerland and Great Britain. The delivery countries actually available in the checkout for the respective order are decisive.
4.2 Unless a different delivery time is specified for the respective product, the following delivery times apply:
Germany: 1 to 2 business days. Delivery on Saturday is possible.
Austria, Italy, France, Netherlands, Belgium, Luxembourg and Denmark: 2 to 4 working days.
Spain, Great Britain and Switzerland: 2 to 5 working days.
Shipping items: 3 to 5 working days.
4.3 If advance payment has been agreed, the delivery period begins after receipt of payment. For other payment methods, the delivery period generally begins with the conclusion of the contract.
4.4 If an ordered item is not available at short notice or delivery is delayed, we will inform the customer by email, if possible.
4.5 As soon as the order has been handed over to DHL, a shipping company or another shipping partner, the customer will receive a shipping confirmation by email with a tracking link, if available for the respective shipping method. If necessary, the tracking link can also be accessed via the order information.
4.6 Delivery to DHL Packstations is currently not possible.
4.7 Due to the automated transmission of orders to our logistics center, a subsequent change to the delivery address cannot be guaranteed. During our business hours Monday to Friday between 9:00 a.m. and 5:00 p.m. we may attempt to adjust an order within 30 minutes of receipt of the order. There is no entitlement to a subsequent change.
4.8 If the customer has provided an incorrect or incomplete delivery address and this results in additional shipping, storage or return costs, the additional costs actually incurred and necessary can be invoiced in accordance with legal regulations, provided that the customer is responsible for their occurrence.
5. Shipping costs
5.1 For deliveries within Germany and Austria, shipping is possible from an order value of €20.00 free. For an order value under €20.00 the shipping costs are 2,99 €.
5.2 For deliveries to Italy, France, the Netherlands, Belgium, Luxembourg, Denmark and Spain the shipping costs are 10,00 €.
5.3 For deliveries to Switzerland and Great Britain the shipping costs are 20,00 €.
5.4 Different shipping costs may apply for shipping items. The actual shipping costs incurred will be displayed to the customer in the checkout before completing the order.
6. Delivery of freight forwarding items
6.1 Goods marked as shipping items and those that are large, heavy or cannot be sent as parcels are delivered by a shipping company or large parcel service.
6.2 Delivery takes place in principle free curbside to the delivery address specified by the customer. Moving the goods into the building, into the apartment or to a specific installation location is not part of the service owed unless this has been expressly agreed upon separately.
6.3 The regular delivery time for shipping items is, unless otherwise stated for the respective item, 3 to 5 working days. Due to the need to coordinate appointments, the actual delivery time may vary slightly.
6.4 Forwarding items are not shipped via our regular DHL GoGreen parcel shipping.
6.5 If an appointment is required for a forwarding delivery, the customer must do so when ordering Current and available telephone number specify. The shipping company or transport service provider needs this telephone number to coordinate the delivery date with the customer.
6.6 The customer must ensure that the contact and delivery details provided when ordering are correct and up-to-date and that it is possible for the shipping company or transport service provider to contact you to arrange an appointment.
6.7 In the case of freight forwarding deliveries, the customer must cooperate to a reasonable extent in arranging the appointment and carrying out the delivery. A bindingly agreed delivery date must be observed by the customer.
6.8 If a forwarding delivery cannot be carried out for reasons for which the customer is responsible, we can, in accordance with legal regulations, demand compensation for the additional expenses actually incurred and required as a result. This can be the case in particular in the case of incorrect or incomplete contact or delivery data, a culpable lack of availability despite the required appointment, a culpable failure to observe the bindingly agreed delivery date or an unjustified refusal to accept delivery.
6.9 The additional expenses mentioned in Section 6.8 may include, in particular, costs for an unsuccessful delivery attempt, storage costs, costs of renewed delivery and necessary return transport costs. Depending on the size of the shipment, delivery region and transport costs, experience has shown that such additional costs can amount to around €80 to €300. However, only the additional costs actually incurred and legally reimbursable are decisive.
7. Cancellation policy
Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reasons.
The cancellation period is fourteen days from the day
- on which you or a third party named by you who is not the carrier took possession of the goods, provided that a uniform delivery takes place;
- on which you or a third party named by you who is not the carrier took possession of the last goods, provided you have ordered several goods as part of a single order and these are delivered separately;
- on which you or a third party named by you who is not the carrier took possession of the last partial shipment or the last piece, provided the goods are delivered in several partial shipments or pieces.

inform you of your decision to withdraw from this contract by means of a clear statement, for example by letter or email. You can use the model cancellation form listed under section 8, although this is not mandatory.
You can also revoke your consent using the electronic function provided on our website “Cancel contract” explain. If you use the electronic cancellation function, we will confirm receipt of your cancellation immediately on a durable medium, in particular by email.
To meet the cancellation deadline, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires or transmit the cancellation before the cancellation period expires using the electronic cancellation function.
Consequences of revocation
If you revoke this contract, we must repay all payments we have received from you, including delivery costs, immediately and no later than fourteen days from the day on which we received notification of your revocation of this contract.
Excluded from the refund are additional delivery costs that arise because you chose a different type of delivery than the cheapest standard delivery we offer.
For this repayment we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. You will not incur any additional costs as a result of the repayment.
We may refuse repayment until we have received the goods back or you have provided evidence of having sent the goods back, whichever is earlier.
You must return or hand over the goods immediately and no later than fourteen days from the day on which you inform us of the cancellation to us or to the return address specified for the respective shipping method. The deadline is met if you send the goods before the fourteen day period has expired.
Return shipping costs
For goods that can be sent as a parcel, we will cover the direct costs of returning the goods if the return procedure provided by us or a return label provided by us is used for the return.
If you do not use the return procedure provided by us to return an item that can be sent via parcel, you will be responsible for the resulting return costs yourself.
For goods that cannot be returned normally using a parcel service due to their nature, in particular freight and pallet goods, you will bear the direct costs of the return.
For forwarding items within Germany and Austria, the costs of a return will be charged - depending on the item, pickup location and transport costs a maximum of around €250 appreciated. Experience shows that the costs are between approx 80€ and 250€.
Before shipping goods are returned, you must consult with us. The specific return address and the organizational details of the shipping return will be communicated to the customer after contact. In order to arrange a pickup appointment, a current and accessible telephone number must be available.
For goods that cannot be sent as parcels, the amount of the return costs or a reasonable estimate of the expected return costs will be communicated before the contract declaration is submitted for the respective product or in the ordering process.
Value replacement
You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.
Exceptions to the right of withdrawal
The right of withdrawal does not exist or may expire prematurely if this is provided for by the legal regulations, in particular Section 312g Paragraph 2 of the German Civil Code (BGB).

9. Retention of title
9.1 The delivered goods remain our property until the purchase price has been paid in full.
9.2 We reserve ownership of the delivered goods from entrepreneurs until all claims arising from the ongoing business relationship have been settled in full.
10. Liability for defects and warranty
10.1 The statutory liability rights for defects apply to the goods we offer.
10.2 If the delivered goods are defective, the customer is entitled to the legal rights to subsequent performance and, if necessary, reduction in price, withdrawal and compensation in accordance with the legal requirements.
10.3 If a complaint about a defect is justified, we will bear the statutory costs of supplementary performance.
10.4 Goods replaced as part of subsequent performance must be returned to us upon appropriate request and at our expense, to the extent this is provided for by law.
10.5 Any additional guarantees we offer exist independently of the statutory defect rights. The customer's legal rights are not restricted by a guarantee. Details can be found in the respective guarantee conditions.
11. Transport damage
11.1 If goods are delivered with obvious transport damage, we ask the customer to note or complain about such damage to the delivery person or driver as soon as possible and to contact us as quickly as possible.
11.2 Failure to make such a complaint has no impact on consumers' statutory warranty or defect rights.
12. Liability
The statutory provisions apply to claims for damages.
The statutory provisions of product liability law as well as liability for damages resulting from injury to life, body or health remain unaffected.
13. Data Protection
Information about the collection, processing and use of personal data can be found in our current data protection declaration on our website.
14. Applicable Law
14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
14.2 For consumers, this choice of law only applies to the extent that it does not deprive the consumer of the protection granted to the consumer by mandatory provisions of the country of his habitual residence.
15. Jurisdiction
The statutory jurisdiction regulations apply to consumers.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is - to the extent permitted by law - the registered office of Dunasan GmbH.
16. Consumer Dispute Resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
17. Voluntary 30-day return option
17.1 In addition to the statutory right of withdrawal of fourteen days, we voluntarily offer consumers the option to return the item within a period of 14 days 30 days from receipt of the goods on.
17.2 The statutory cancellation regulations apply within the statutory cancellation period. After the statutory cancellation period has expired, the goods can be returned within a total of 30 days from receipt within the framework of our voluntary return conditions.
17.3 The prerequisite for a return after the statutory cancellation period has expired is that the goods are complete and show no damage or signs of use that go beyond the handling required to inspect the goods.
17.4 Goods for which the statutory right of withdrawal is excluded or which has expired prematurely are generally also excluded from the voluntary return option.
17.5 For goods that can be sent by parcel, we provide a free return label for voluntary returns, provided that our return procedure is used. If goods cannot be sent via parcel or on a pallet, the customer bears the direct return costs.
17.6 If the return is made exclusively due to our voluntary return option after the statutory cancellation period has expired, we will refund the purchase price paid for the returned goods. In this case, the original shipping costs will not be refunded unless we have expressly agreed otherwise.
17.7 For details about our voluntary 30-day returns policy, please visit our Returns & Refunds page. The voluntary return option does not limit your legal rights, in particular not your statutory right of withdrawal and your statutory warranty rights.
18. Final provisions
If individual provisions of these General Terms and Conditions are or become ineffective in whole or in part, the remaining provisions remain unaffected. The statutory provisions apply in place of the invalid provision.
